This Data Processing Agreement ("DPA") supplements the agreement between you ("Customer" or "Controller") and AI4Web Private Limited ("AI4WEB" or "Processor") for the provision of the AI4WEB service. It applies where you process personal data of EU/UK/EEA data subjects using the service.
1. Subject matter & duration
We act as processor when handling personal data on your behalf to provide the service. This DPA remains in force for the duration of your subscription and any period during which we retain personal data on your behalf.
2. Categories of data & data subjects
Data subjects: your customers, prospects and visitors to your generated websites; your team members; any contacts whose details you upload.
Categories of personal data: name, email, phone, address, IP address, geolocation, contact-form submissions, lead information.
3. Processor obligations
- Process personal data only on documented instructions from you
- Ensure persons authorized to process the data are under confidentiality obligations
- Implement appropriate technical and organizational measures (see our Security page)
- Assist you with data-subject requests, security incidents and DPIAs to the extent reasonably required
- Notify you without undue delay (within 72 hours of confirmation) of any personal data breach affecting your data
- Delete or return personal data upon termination of the agreement, subject to legal retention requirements
4. Sub-processors
You authorize us to engage sub-processors as listed on our Sub-processors page. We impose materially equivalent data-protection obligations on every sub-processor and remain liable to you for their performance. We will give reasonable notice before adding or replacing sub-processors.
5. International transfers
Where personal data is transferred outside the EU/UK, the EU Standard Contractual Clauses (2021) are incorporated into this DPA by reference, with us as data importer and you as data exporter (Module Two: Controller to Processor).
6. Acceptance & signature
For a countersigned DPA on company letterhead, email info@ai4web.in with your company name and tax ID. We will return a signed PDF within five business days.
